Terms and Conditions

Please read these terms carefully before using Examlit. They cover your account, subscriptions, Shop purchases, acceptable use and our responsibilities to you.

01Interpretation and Definitions

Interpretation

Words with a capitalised first letter have the meanings defined below. These definitions have the same meaning whether they appear in singular or in plural.

Definitions

Account
A unique student, teacher or institution (partner) account created for You to access the Service.
Affiliate
An entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
Company
"the Company", "We", "Us" or "Our" refers to Examlit, a product of Masomo Point, 65001, Wazo, Dar es Salaam.
Content
Everything made available through the Service, including past papers, marking schemes, model answers, quizzes, topical questions and answers, flashcards, simulations, generated exam papers and Shop bundles.
Country
Tanzania.
Device
Any device that can access the Service, such as a computer, a mobile phone or a tablet.
Order
A purchase from the Examlit Shop of a topical questions or past paper bundle, as a digital (PDF) or printed copy.
Plan
A paid subscription — for students, teachers or institutions — that unlocks premium parts of the Service for a set billing period.
Service
The Website and everything offered through it, including the Content, live classrooms, trivia, the blog, Plans and the Shop.
Terms
These Terms and Conditions, which form the entire agreement between You and the Company regarding the use of the Service.
Third-party Service
Any service or content provided by a third party that is displayed, included or made available through the Service, such as payment providers and Google Sign-In.
Website
Examlit, accessible from https://examlit.com.
You
The individual accessing or using the Service, or the school, company or other legal entity on whose behalf that individual is accessing or using it.

02Acknowledgment

These Terms govern the use of the Service and the agreement between You and the Company. They set out the rights and obligations of everyone who uses the Service, and apply to all visitors, users and others who access or use it.

By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of them, You may not access the Service.

Students under 18: You may use the Service with the consent of a parent, guardian or Your school, who accept these Terms on Your behalf. Children under 13 may only use the Service through an account set up or approved by a parent, guardian or school.

Your use of the Service is also conditioned on Your acceptance of Our Privacy Policy, which describes how We collect, use and disclose Your personal information. Please read it carefully before using the Service.

03Your Account

  • Give accurate information when You register, and keep it up to date.
  • Keep Your password safe. You are responsible for all activity on Your Account.
  • Accounts are personal. Do not share Your login or let others use Your subscription.
  • Tell Us straight away if You suspect someone else has accessed Your Account.

Teachers and institutions are responsible for the students and staff they add or invite, and for having any consent needed to do so.

04Plans and Payments

Some parts of the Service are free; others need a Plan. Plans are available for students, teachers and institutions, billed monthly, quarterly, semi-annually or annually as shown on the pricing page at the time of purchase.

Prices

Prices are set in US dollars. Mobile money payments are charged in local currency at the exchange rate at the time of payment.

Payment methods

We accept Vodacom M-Pesa (Tanzania), mobile money through Tingg, Flutterwave, and cards or PayPal. Payments are processed by those providers under their own terms.

Billing period

A Plan starts when payment is confirmed and lasts for the billing period You chose. Plans do not renew automatically; We email You a reminder before Yours expires.

Institution plans

Institution prices depend on the number of students and teachers You choose, and cover the members added to Your institution account.

05Shop Orders

The Examlit Shop sells topical questions and past paper bundles as digital (PDF) downloads or printed copies. Prices are confirmed when You place Your Order.

Digital copies

Unlocked as soon as payment is confirmed. You can download them from My Orders, and We email You download links.

Emailed links expire after a period for security; You can always get fresh links from My Orders.

Printed copies

Collected from the pickup point You choose at checkout. A delivery fee for that pickup point is charged once per Order.

We will contact You on the phone number You give when Your Order is ready for collection.

Personal use only. Bundles are licensed for Your own study (or, for teachers, use with Your own classes). You may not resell, share publicly or redistribute them.

06Refunds

If You were charged in error, charged twice, or a purchase does not work as described, contact Us with Your payment or order reference and We will review it. Approved refunds are returned through the original payment method.

Because digital content is delivered immediately, Plans that have been used and digital bundles that have been downloaded are generally not refundable, except where required by law. Printed Orders may be cancelled for a refund until they are ready for collection.

07Acceptable Use and Content

The Content is provided to help You learn and prepare for examinations. Past papers and marking schemes remain the property of their respective exam boards; Our questions, answers, simulations and other materials belong to the Company or its licensors.

When using the Service, You agree not to:

  • copy, scrape, resell or publicly redistribute Content;
  • share Your Account or try to get around payment or access controls;
  • cheat in, disrupt or abuse quizzes, trivia battles or classrooms;
  • harass other users or post unlawful or offensive material;
  • upload viruses or try to interfere with the security or operation of the Service.

09Termination

We may suspend or terminate Your access immediately, without prior notice or liability, for any reason, including if You breach these Terms.

Upon termination, Your right to use the Service will cease immediately.

10Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service, or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury or loss of privacy) arising out of or in any way related to the use of or inability to use the Service, third-party software and/or hardware used with the Service, or otherwise in connection with any provision of these Terms, even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Note: Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply. In those jurisdictions, each party's liability will be limited to the greatest extent permitted by law.

11"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE", with all faults and defects, without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limiting the foregoing, neither the Company nor any of its providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content and materials or products included on it; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability or currency of any information or content provided through the Service, including model answers and generated papers; (iv) that use of the Service will lead to any particular examination result; or (v) that the Service, its servers, the content, or emails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

12Governing Law and Disputes

Governing law

The laws of Tanzania, excluding its conflict of law rules, govern these Terms and Your use of the Service. Your use may also be subject to other local, national or international laws.

Resolving disputes

If You have any concern or dispute about the Service, You agree to first try to resolve it informally by contacting Us.

European Union users

If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.

United States legal compliance

You represent and warrant that You are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and that You are not listed on any United States government list of prohibited or restricted parties.

13Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, it will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, failing to exercise a right or to require performance of an obligation under these Terms does not affect a party's ability to exercise that right or require that performance at any time afterwards, nor does waiving a breach waive any later breach.

14Translation

These Terms may have been translated if We have made them available to You on the Service. You agree that the original English text prevails in the case of a dispute.

15Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to give at least 30 days' notice before the new terms take effect. What counts as a material change is determined at Our sole discretion.

By continuing to access or use the Service after revisions take effect, You agree to be bound by the revised terms. If You do not agree to them, in whole or in part, please stop using the Website and the Service.
